Castle Valley planning commission recommends ordinance amendments to align subdivision rules and forwards them to Town Council

The Planning and Land Use Commission of the Town of Castle Valley on Thursday voted to accept revisions to Ordinance 85-3 and recommended the amended ordinance be forwarded to the Town Council for final approval.

The commission’s recommended changes replace the term “lot division” with “subdivision” throughout the ordinance, update cross‑references and dates, designate the Planning and Land Use Commission as the land use authority to review applications for one‑ and two‑family residential subdivisions under the amended Subdivision Ordinance, and specify that the Town Council will serve as the appeal authority for those applications.

Commission members discussed a sequence of redline changes on multiple pages of the ordinance, including edits to section 3.1.3 (Planning and Land Use Commission duties), section 3.2.3 (Town Council duties as appeal authority), and the approval chart in section 5.6. Commissioners noted that the update brings the town code into alignment with the recently amended Subdivision Ordinance (referred to in the draft as Subdivision Ordinance 2004‑3/2004‑3 amendment) and corrects dated references shown on the marked copy.

A motion to accept the changes as written and forward the amended Ordinance 85‑3 to the Town Council passed by voice vote; commissioners responded “aye.” The commission will present the ordinance with a public hearing before the Town Council.

The commission’s packet included a marked copy with strikethroughs and underlines showing the substituted language, the removal of the word “subdivision” from some places and its insertion in others, and a revised appeals paragraph (7.20.2) that references limitations contained in related ordinances.

The item will proceed to the Town Council for verification and final action.
