One council member moved to table the item, citing a lack of defined procedures, uncertainty about whether a mural constitutes an encroachment or a vertical easement on private property, potential effects on appraised values and how lienholders would be notified or approve encumbrances.
The motion to table was seconded; council members also suggested that private-property murals be presented first to the downtown committee and that staff and legal develop clear application and oversight procedures addressing materials, maintenance, condition standards and access issues (for example, access across roofs or parking lots when work touches adjoining buildings).
Council agreed to table the ordinance for 60 days to allow legal and staff review and to solicit downtown stakeholder input. The motion passed by voice/hand vote with no opposition recorded.
The tabling preserves the status quo while staff and legal draft procedures and bring back recommendations to council for a future decision.
