Joe Betancourt said the applicant has completed on‑site electrical service and is no longer using a generator. He said the operator had used a 3‑yard construction dumpster during build‑out; that dumpster was not part of the approved use permit. The operator told staff the dumpster was for construction and that smaller 64‑ or 96‑gallon bins would replace it; staff said the bins would be screened near the portable restroom area if the operator seeks to keep on‑site trash collection. Betancourt said the operator also obtained Cal Water service and that the encroachment permit for water service was final.
Commissioners raised additional compliance questions: why delivery trucks are returning product to the site if a commissary was promised, and whether employee or customer vehicles are using the approved off‑site parking. Betancourt said he would contact the county environmental health office to confirm commissary arrangements and would inspect parking patterns to determine whether on‑site parking is being used in contravention of the permit.
Why it matters: The review examines whether the operator is following conditions of approval tied to public health and neighborhood impacts; persistent noncompliance could require a formal modification or enforcement action.
Next steps: Staff will return to the commission with a written report on commissary verification, parking use and a recommended resolution for the on‑site dumpster issue (either permit modification with screened enclosures and weekly pickup, or a return to daily off‑site removal). Any permit modifications will be scheduled as a formal action item.
