Committee reviews proposed amendments to Somerville—s tree preservation ordinance; keeps item in committee

City urban forestry staff and the city solicitor presented proposed amendments to Somerville—s Tree Preservation Ordinance at the Committee on Legislative Matters meeting on April 1, and the committee left the item in committee for additional refinement.

Vanessa Bukele, senior urban forestry and landscape planner in the Public Space and Urban Forestry Department, summarized the amendments developed with the Urban Forestry Committee and city departments. Bukele said the amendments are intended “to better protect the trees in the city” and listed major changes: new provisions protecting public shade trees and city trees from damage during outdoor construction; a new permit process for pruning public shade trees; protection requirements for private significant trees during construction; a reduction of the owner‑occupant waiver from a 100 percent replanting/payment exemption to a 90 percent reduction of mitigation requirements; and a consolidated, strengthened enforcement section. Bukele also said the proposal would align the Youth Urban Forestry Committee appointment schedule with the academic year to improve recruitment and retention.

Councilors and staff spent most of the discussion on enforcement mechanics and remedies. Assistant City Solicitor Meredith Stivers explained distinctions in enforcement paths between state law and municipal remedies, saying Massachusetts General Laws c.87 includes procedures that can require court action in some cases and that the city has other “self‑help” enforcement tools (tickets, fines) it can use. Stivers and urban forestry staff said the building code—s stop‑work authority is a complex area that likely cannot be expanded by ordinance without further legal and ISD review; city staff removed proposed stop‑work language after consulting ISD and law because it appeared to be a gray legal area.

Committee members pressed whether the city can obtain injunctive relief quickly enough to stop active tree removal; staff acknowledged that obtaining injunctions can be slow and that the ordinance instead strengthens daily fines and other civil remedies. Staff said the amendments add a fine structure in which ongoing violations can be fined daily, and that the city is working to make enforcement financially meaningful where possible. Bukele said permitting and waiver hearings have been rare and that the city will deny waivers when applicants appear to have willfully violated the ordinance.

Members also discussed preventing repeat offenders, repeat clearance of sites ahead of permits, and the quality of replacement plantings. Staff said the draft contains a 24‑inch rebuttable presumption and that repeat violators do not receive the 30‑day grace period for post‑removal permitting; staff indicated they could clarify language to capture repeat offenders who use different corporate names. Councilors asked staff to tighten standards for replacement plantings so that small “pencil” trees cannot be used to meet mitigation requirements where a large, mature tree was removed; staff said they could add spacing and species standards and consider a historic or special‑tree designation for very large specimens.

The committee did not vote and kept the amendment package in committee. Chair Davis directed staff to return with refined language clarifying enforcement authority, the waiver standard and replacement‑plan quality, and to coordinate further with ISD and the city solicitor. Staff said they would attempt to expedite revisions.
