Commission approves county participation in Optum class-action services for alleged Walgreens overcharges

Cole County commissioners approved a motion to sign an agreement authorizing Optum to provide class-action services related to a claim that Walgreens overcharged for prescriptions during the period Feb. 2007 to Feb. 2024. Staff said UMR (the county’s carrier at the time) notified customers about the class-action matter and that Optum would administer any recovery if the county elects to participate.
Staff explained Optum would manage the class-action process for members who were customers of UMR during the covered period; if the county received any recovery Optum would take an 18% contingency fee and remit the remainder to the county. County staff said they had checked with UMR and determined there was no downside to participating and recommended joining the group.
Commissioners moved and approved signing the Optum agreement to participate as a potential plaintiff in the class action; no recovery or liability was determined at the meeting.
