The Planning Commission recommended March 13 that the City Council grant an exception to the sensitive-lands ordinance for retaining‑wall work constructed without prior approvals at 760 South 1480 West (HIL25-01).

The agent, Terry Spinks, and applicant Kendra Elliott appeared before the commission after a neighbor reported that retaining walls had been extended beyond the originally approved construction drawings. Planning staff reviewed the as-built engineering certifications and concluded the work meets the four criteria for an exception under the sensitive‑lands provisions. "Based on the analysis we did, it meets the criteria for granting exception to the sensitive lands ordinance," planning staff said.

Staff and the commission emphasized they do not encourage after‑the‑fact construction without permits, but noted the engineering certifications and the nature of the site — not a natural hillside with unique landforms — weigh in favor of granting the exception rather than ordering removal. Commissioners asked what consequences would follow if the exception were denied; staff said removal would be possible but could cause more hazard or damage to surrounding structures than leaving the certified wall in place.

After discussion a commissioner moved to recommend the exception to the City Council; the motion was seconded and approved by voice vote. The item will be placed on the City Council agenda for final action and the commission advised neighbors of the opportunity to testify at that hearing.
