The Hurricane City Planning Commission on Feb. 27 voted to table a request from 317 Sycamore LLC for a zone change and preliminary site plan (filed as ZC24-07 and PSP24-201) after staff and the applicant said a cooperation agreement with neighboring property owners was not available for review.
Planning staff told the commission the parcel and the proposed development require easements from properties to the east and west to provide a second access and to complete a water looping arrangement. Staff and the applicant said they had expected a signed cooperation agreement would be available by the meeting but it was not. Staff recommended the commission table the item until the easement/cooperation language is finalized; the motion to table carried by voice vote.
The application would change a neighborhood commercial property to R18 with a Planned Development Overlay and includes a preliminary site plan. Staff said the tabling pauses the commission's consideration until the applicant provides a formal agreement from the neighboring parcel owner that outlines how access and water looping easements will be placed and finalized. According to staff discussion at the meeting, the easement locations and the water-looping design are necessary to confirm fire access and adequate water pressure and could not be fully resolved at the preliminary site‑plan stage.
Commission members and staff said tabling will allow the applicant and adjacent property owners to document the access easements and water arrangements and return the item when those documents are available. The applicant/agent — identified in the packet as Bo Aguela representing 317 Sycamore LLC — participated remotely and acknowledged the cooperation agreement was outstanding. No vote tally was recorded on the record; the chair announced the item was tabled.
The commission noted that, because the cooperation agreement is a contractual matter between private owners, the item will be placed back on the commission agenda once the applicant notifies planning staff that the required agreement is ready for review.
