Human Rights Commission homelessness work group raises questions about unsanctioned encampment protocols, rental protections and disaster response

The Human Rights Commission’s Homelessness & Poverty work group updated commissioners on three principal subjects: (1) emergency response and natural-disaster impacts on housing and the shelter system, (2) gaps in renter protections that allow larger rent increases between tenancies than during lease renewals, and (3) the city’s unsanctioned encampment posting and removal protocols.

Work group members said they are preparing questions for the city’s emergency management and landlord-regulation staff about how disasters affect vacant-unit pricing and rebuilding. Commissioners cited recent wildfire responses in neighboring counties where environmental or regulatory barriers prevented some displaced residents from rebuilding, which in turn diminished housing access.

On unsanctioned encampment protocols, the work group reviewed city postings that include a 72-hour public-way notice and shorter notices in parks. Members discussed where the commission’s earlier protocol recommendations might be added to current procedures, including more consistent use of the city’s shelter finder tool and clearer messaging to people whose personal property is at risk during removals.

The group also flagged a notice from Councilor Groves about ordinances concerning transference of goods and money from vehicles, shopping-cart removal and sale of scrap metal; commissioners requested data about whether enforcement of such ordinances has caused demonstrable safety harms or disparate impacts on protected groups, and whether enforcement could criminalize charitable acts (for example, handing a sandwich to a person in need).

Members will submit a written set of questions to staff about enforcement data and expected disparate impacts and will discuss responses in a follow-up work-group meeting.
