Administration seeks APA exemption for Prop 4 program guidelines; LAO recommends safeguards

The administration told the Assembly Budget Subcommittee No. 4 it plans to include trailer bill language that would exempt the development and adoption of program guidelines and selection criteria for Proposition 4 programs from the Administrative Procedure Act (APA), arguing the exemption will speed implementation and avoid delays.
"The administration also proposes to exempt the development and adoption of program guidelines and selection criteria needed to effectuate or implement climate bond programs from the Administrative Procedures Act," said Lizzie Eri of the Department of Finance.
Why it matters: Without an APA exemption, the administration warned, some programs could be delayed a year or more because of the formal rulemaking process, slowing the distribution of bond funds for projects described in Proposition 4.
LAO view and legislative options
Sonia Pedic of the Legislative Analyst's Office told the subcommittee the LAO supports the APA exemption for Proposition 4, subject to guardrails. "We do recommend approving the governor's proposal for the APA exemption for proposition 4," she said, while noting that the Legislature could require the administration to publish proposed guidelines online, allow a public comment period, and hold public meetings to maintain transparency.
Members asked whether the administration would consider a broader APA change to avoid repeated exemption requests. Department of Finance responded it is open to discussions with the Legislature but framed the current request as limited to the climate bond to remain responsive to voter intent.
Next steps
Committee members signaled they will work with administration and LAO to craft legislative language that balances faster implementation with explicit public‑engagement requirements. Staff were directed to return with possible trailer bill language to capture those public process expectations.
