Council adopts text amendments to Lockhart zoning code for portable food establishments

Lockhart City Council adopted Ordinance 2025‑07 (approved 7–0) to update zoning language for portable food establishments, removing a duration‑based exemption so the city may inspect and permit mobile food operators regardless of how long they remain at a location, while retaining a separate exemption for short, organized outdoor events.

Building Official Andrew Devaney explained that the current definition excluded portable food establishments that operated fewer than four consecutive days from city permit and inspection requirements. The amendment removes the “four‑consecutive‑days” limitation so staff can inspect any portable food establishment operating within the city and require both a local inspection and a current mobile food unit permit from the Texas Department of State Health Services.

Devaney told council that Planning & Zoning recommended the amendment unanimously at its March 12 meeting but that staff revised a proposed deletion to retain subsection (e), which preserves an exemption for annual outdoor community events that last no more than four consecutive days (examples given included Cinco de Mayo, Courthouse Nights and the Texas Monthly Barbecue Festival). Even when exempt from Chapter 64 zoning, such short events will still be required to meet health and sanitation rules under Chapter 26 of the city code.

Council adopted the ordinance on a unanimous vote.

Why it matters: The change lets Lockhart enforce local health and zoning standards for mobile food operators that previously evaded local review when operating for short durations, while preserving an exemption to avoid imposing zoning requirements on established short community festivals.
