Rosenberg council approves MUD 269 agreement to build and maintain Rye Hill Parkway section

The Rosenberg City Council on April 1 approved Resolution R-3851 authorizing an agreement with Fort Bend County Municipal Utility District (MUD) 269 for construction and maintenance of public infrastructure on a 17.58-acre tract inside the city limits tied to the Rye Hill master-planned development.

City staff, represented at the meeting by Mister Calchemy, said the district will construct Rye Hill Parkway across the 17.58-acre Rosenberg tract as a divided boulevard with concrete curb and gutter and associated water, sanitary sewer, storm sewer and drainage infrastructure. The district will construct and maintain that infrastructure and will provide ongoing operation and maintenance for the roadway and utilities on the Rosenberg tract, Calchemy said.

The district also plans to construct a traffic signal at the intersection of Rye Hill Parkway and FM 762 to meet TxDOT requirements. Calchemy told the council that the eventual transfer of maintenance responsibility for the signal from TxDOT to the city will trigger a separate agreement requiring the district to maintain the signal until that transfer occurs. At the meeting a council member estimated modern traffic signals may cost about $525,000.

Staff recommended approval, and the council voted to approve the resolution. The mayor called the vote, and the clerk announced, “The ayes have it. 5 to 2 absent.”

Why it matters: the approved agreement removes near-term maintenance responsibility from the city for the portion of roadway and signal located inside Rosenberg city limits, while allowing the large Rye Hill development’s traffic to cross a short segment inside the city.

What’s next: the district will proceed with construction and will enter a future agreement with the city concerning signal maintenance after TxDOT transfers responsibility when the city’s population threshold is reached.
