Commission approves conditional use permit for tattoo parlor at 1720 S. Clack Street despite neighbor trash concerns

City planner Kira Velois presented CUP 2025-58 on behalf of agent Mike Diaz, saying staff received one favorable response and recommended approval subject to the proposed plan of operation, which includes hours of operation. The public hearing drew one speaker, nearby resident Sheree Carter, who said her family has owned a home nearby for 55 years and described recurring trash problems in a shared alley. Carter said she was not opposed to the tattoo shop itself but asked for at least one commercial trash container to reduce overflow and potential cross-contamination.
Applicant Michael Diaz addressed disposal of regulated waste, saying tattoo needles are placed in sharps containers and collected by a contracted service and that they comply with the Texas State Health Department. Diaz agreed a commercial trash container could help and was advised to coordinate with city services about solid-waste collection.
Commissioner Kiker moved to approve the permit subject to the plan of operation; Commissioner Shontay seconded. The roll call vote was recorded as: Commissioner Barnett — yes; Commissioner House — yes; Commissioner Kiker — yes; Commissioner Halliburton — yes; Commissioner Lewis — yes; Commissioner Benham — yes. The motion carried.
Staff noted the plan of operation covers hours (the application listed 10 a.m. to 11 p.m.) and other standard operating conditions. Commissioners said while land use decisions do not directly set solid-waste collections, the city’s sanitation division could be asked to review trash-container needs for the alley.
