Board continues multiple petitions to May 6 after staff publication error

The Metropolitan Board of Zoning Appeals Division 1 unanimously continued a series of petitions to the board’s May 6, 2025 hearing after staff reported a publication error affected legal notice filings.

Staff cited a publication error and asked the board to continue the following cases to the May 6 hearing date without additional notice: 2025DV1008 (1910 Mansfield Street), 2025DV1009 (8415 West Washington Street), 2025DV1010 (6901 and 6951 Michigan Road), 2025DV1011 (6445 North Illinois, Town of Meridian Hills), 2025DV1012 (8130 Rockville Road), 2025DV1013 (1933 West 604th Street, amended), 2025DV1014 (7612 West 903rd Street), 2025DV1015 (909 North Parishing Avenue), 2025UV1004 (3950 Meadows Drive), and 2025UV1005 (2225 East Tenth Street). Each continuance was moved, seconded, and approved with recorded yes votes from Jennifer Witt, Tom Barnes, and Chairperson Peter Nelson.

Board procedure: Chairperson Peter Nelson reminded attendees of the board’s rules of procedure and that a three-vote majority is required to act. For each item staff noted the publication error as the reason for continuance; petitioners or the public in attendance were asked if they opposed the continuance and none voiced objection for the listed items.

One additional petition on the agenda, 2025DV1005 (6462 Broadway Street), was continued after staff said the petitioner was not present and had indicated openness to continuation. The board approved that continuance as well.

The continuances move multiple hearings to the May 6 docket and preserve petitioners’ rights to be heard at that date without additional notice per staff’s request.
