Council approves emergency MOU with Cooper's Hawk, exempts tenant from community-events clause

The Seven Hills City Council voted Aug. 26 to authorize the mayor to enter into a memorandum of understanding with Cooper's Hawk 7 Hills LLC and approved an amendment that exempts that tenant from the development agreement's community-events provision.
Ed Foley, a member of the Planning Commission, described the negotiated change as a targeted alteration to the planned unit development (PUD) for the property. "The issue we have in front of us is a PUD has certain components to it... One of the aspects of that would be that it's supposed to encourage community gatherings," Foley said, explaining why the city had previously included a community-events clause in development agreements.
Foley said the prospective tenant, Cooper's Hawk, asked to be excused from the agreement's community-events provision, identified in the development agreement as section 3.8. "They have asked that they be excused from this ... 3.8 is the community events portion of the development agreement," Foley said, and recommended removing that clause for this tenant only to facilitate the deal while keeping the city's standards in place for other property owners.
Council members discussed the request briefly. A council member noted the tenant had applied for a liquor license and invested in land development and that engineering plans were under way, but the meeting record states the contract was not yet signed and the tenant was not contractually obligated. Council members emphasized the exemption would apply only to Cooper's Hawk and would not remove the community-events requirement from the development agreement generally.
Councilman Snitsky moved to suspend the rules and read Ordinance 41-2025 by title only for its first and final reading; the council approved the emergency clause and then passed the ordinance as an emergency measure on roll call, with voting members recorded as "yes." The ordinance authorizes and directs the mayor to enter into a memorandum of understanding on behalf of the City of Seven Hills with Cooper's Hawk 7 Hills LLC.
The ordinance passed with no recorded amendments during the meeting. The council record shows the exemption is limited to the named tenant; the MOU and any final development contract remain subject to later signatures and separate contractual obligations.
