The board approved a resolution ordering closure of the specific segment described in the petition, finding a public benefit, that the portion “has not been used for 10 years,” that there are readily accessible alternate routes and that closure will not affect drainage, consistent with North Dakota Century Code 24-07-03. Commissioner Wilhelmi, Commissioner Volk, Commissioner Hodes, Commissioner Britt and Commissioner Gessner recorded aye votes in roll call.
Attorney Doug Golding, representing petitioners Dan and Jean Jansen, told the commission the petition was supported by a survey and mapping exhibits and argued the public benefit included facilitating residential development on nearby large lots and removing a practical obstacle presented by a house that intersects the section line. Golding said an alternate access route had been dedicated to the township and that adjoining landowners had submitted consents.
Neighboring residents and a local real-estate developer spoke in favor. Alfred, a local real-estate professional, said the closure corrects a mistake that left a house and a saleable lot with a section-line encroachment and that services and access run along the nearby north–south road rather than along the section line.
After public comment and review of notice and survey exhibits, a commissioner moved to accept the petition and adopt the proposed resolution. The motion passed on a unanimous roll call.
The commission’s action will be memorialized in a written resolution; the petitioner’s counsel provided copies to the auditor at the hearing and the county will record the closure action as required by statute.
