Health Committee advances four bills in work session; amendments added to each

CARSON CITY — The Nevada Assembly Committee on Health and Human Services on March 31 amended and voted to forward four bills from its work session, moving each to the next legislative stage with committee-assigned floor statements.

The measures advanced were Assembly Bill 234, requiring Medicaid coverage for certain cancer screening; AB244, prohibiting the use of disposable polystyrene-foam foodware by larger food-dispensing establishments with staged penalties and a later full ban; AB266, which makes revisions related to breastfeeding including education and nondiscrimination protections; and AB284, directing Medicaid reimbursement rates for vagus nerve stimulation devices and parts.

The committee’s nonpartisan analyst, Davis Florence, summarized each bill for members before motions were offered. Motions to “amend and do pass” were made and seconded for each bill; recorded makers and seconds include Vice Chair Winn and others as noted in committee minutes.

AB234: The bill as amended would require the Department of Health and Human Services to include coverage under Medicaid for screening for lung and prostate cancer and evidence-based colorectal screening methods. A Nevada Cancer Coalition amendment to use the term “colorectal” in place of “colon” was noted. Motion: moved by Vice Chair Winn; second by Assembly Member Hunt. Vote: unanimous “aye.”

AB244: The proposal would prohibit food-dispensing establishments with 10 or more locations in Nevada from using disposable foodware made wholly or partly from polystyrene foam, with a phased prohibition (full prohibition beginning 10/01/2029 under the amendment) and civil penalties revised from $1,000 per violation to $100 per day. Motion: moved by Vice Chair Winn; second by Assembly Member Gonzales. Several members reserved the right to change votes later; the motion passed unanimously.

AB266: The bill would require DHHS to post breastfeeding resources (including a fact sheet on Medicaid coverage and community lactation supports) and develop public education on lactation, and it would prohibit denying full and equal enjoyment of a place of public accommodation because a person is breastfeeding. The sponsor submitted an amendment removing a misdemeanor penalty provision. Legal counsel clarified that the bill does not change existing age-based entry restrictions for places of public accommodation (for example, bars or casinos that lawfully exclude minors). Motion: moved by Assembly Member Grama; second by Vice Chair Winn. Vote: motion carried; recorded nays were Assembly Members Hafen, Hibbetts, Edgeworth and Koenig.

AB284: The measure asks DHHS to seek Medicaid reimbursement rates for vagus nerve stimulation therapy devices equal to at least 82% of device cost and at least 80% for replacement parts; an amendment would add a comparable reimbursement floor for implantation or repair procedures. Motion: moved by Vice Chair Wynne (second recorded). Vote: unanimous “aye.”

Committee members’ remarks while voting included several members saying they supported the measures but reserved the right to change their floor vote later, and one measure (AB266) prompted explicit “nay” votes tied to members’ desire to codify legislative intent rather than leave clarifying language to legislative history.

The committee assigned floor statements to sponsoring members for each bill and closed the work session before opening bill hearings for other items on the agenda.
