County to correct earlier land exchange error involving Road 23; survey and amended resolution planned

County staff briefed the Board of County Commissioners about an apparent paperwork and survey discrepancy stemming from a 2012 land exchange that realigned Road 23 and Highway 184.
Staff said the 2012 resolution intended to transfer the former road alignment (shown in red on the meeting graphic) to a private property owner in exchange for land that became the relocated county road. In practice, county records show a small green triangular parcel (0.007 acres) was transferred to the private owner rather than the road segment intended in the original legal description. The triangle had been transferred to the county earlier by the Bureau of Reclamation and subsequently conveyed to the private owner.
Staff recommended the county clean up the chain of title so the owner receives a single, coherent legal description that includes the triangle and the intended road parcel. That will require a new survey and an amended resolution and deed work; staff said the county surveyor (Rita) will prepare the updated survey and that Gerald (who did the original work) will be referenced. Commissioners discussed the possibility of using an exemption amendment as a cleaner legal path and staff noted they will map the new legal description to match the original intent of the board.
No formal corrective deed or resolution was executed at the workshop; staff said they will pursue a full survey, amend the legal descriptions and prepare a revised resolution and deed once the survey is complete. Bureau of Reclamation interests and the irregular property lines mean the process may take time to complete.
Commissioners emphasized that the final road alignment as built is safer than the former alignment and that the paperwork correction is intended to clarify title and legal descriptions for the property owner’s future transactions.
