Juan, a Community Board 11 member who reported the committee’s recommendation, said the absence of required paperwork and community concerns prompted the objection.
“We didn't get a full package, a full application package to the board,” Juan said during the committee report. Committee members also referred to photos presented by Roxanne Delgado, a resident who said she visited the premises and found that the required public notice from the liquor authority was not displayed.
The committee record notes additional community input. Juan said a caller and other attendees told the committee they had observed alcohol served on the premises without a license. The board’s staff reported no representatives of Gustito’s attended the committee meeting to respond to those allegations.
The motion to send a letter of objection passed. Kadian registered an abstention; the committee did not record a full roll‑call tally on the record. The committee also asked staff to request the missing documentation from the applicant and to consider any additional information if it is submitted.
The committee emphasized that distance to nearby schools had been checked and was not the basis for the objection. “We checked that, and they meet the distance requirement between the school and the establishment,” Juan said.
The Community Board’s objection is an advisory letter to the State Liquor Authority and does not itself bar the agency from issuing a license. The board’s letter will become part of the record the Authority reviews.
Board staff said they had reached out to the applicant for the missing documents but had received none by the committee meeting.
The committee’s action will be transmitted to the board’s full record and the State Liquor Authority for consideration.
