The Timberlane Regional School District budget committee reviewed the results of the recent warrant-article recount and heard that 11 of 13 warrant articles passed and two failed.
A staff member summarized the recount results: "After the recount, we have 13 warrant articles. 11 of those warrant articles passed. 2 of them failed." The two failed articles were described in the meeting as article 6 (a petitioned purchase-agreement article) and article 7, a petition that rescinded the school board's 5% fund-balance retention authority.
Committee members asked legal and administrative staff about the practical effect of rescinding the retention authority. Administration said, based on counsel's interpretation, the vote to rescind removes the previously adopted 5% retention and, as a result, leaves the district with a 0% ability to retain fund balance under the district's current interpretation. "Our understanding with our legal counsel now is that the vote was to remove the last prior decision of the voting body... to eliminate 5, our understanding is that we are reverting back to a 0% ability," an administrator said. The administration offered to seek a more formal opinion if the committee desires.
Ending Committee members asked that staff provide any further clarifying legal guidance if requested; administration indicated it could pursue a formal legal confirmation if the committee wants additional certainty.
