Commission approves Brixton’s outdoor amplified-sound amendment after neighbors press for stricter hours

The San Francisco Entertainment Commission voted to approve an amendment allowing the Brixton, a business at 2140 Union Street, to play prerecorded amplified sound outside during expanded hours after hearing oral and written public comment from neighbors who opposed the change.
Staff described the applicant’s requested outdoor hours as Monday–Friday 4 p.m.–10 p.m., Saturday 11 a.m.–10 p.m., and Sunday 11 a.m.–9 p.m. The Brixton’s owner said this schedule reflects longstanding practice at the business since it opened in February 2010 and that the outdoor speakers have been in place "since 1992." Staff noted the commission reconditioned the Brixton’s permit on June 4, 2024, limiting indoor entertainment, and that inspectors recorded five sound complaints after that reconditioning but did not confirm indoor entertainment during visits.
Neighbors opposed the amendment in letters and at the hearing, saying outdoor music is often played when few or no patrons are seated outside and that extended hours are disruptive to residents who work from home. A neighborhood group submitted a late compromise, read into the record by staff, proposing no outdoor amplified sound Monday–Thursday, Friday 3 p.m.–6 p.m., and Saturday–Sunday 11 a.m.–6 p.m., and an additional clause allowing no outdoor music when no patrons are seated or in inclement weather.
The applicant told the commission it preferred the hours it requested and characterized the music as background intended to attract customers, saying, "I just wanna continue using those speakers to provide background music for our patrons and to attract, customers." The owner disputed a neighbor’s assertion about an ABC condition limiting outdoor alcohol service, saying their ABC conditions had changed to permit later service; he said his attorney is researching the paperwork.
Commissioners asked about the applicant’s recent compliance history; staff said the Brixton had been dark for entertainment for nine months and had obtained a one-time indoor permit recently. Commissioners urged the owner to work with neighbors and to be mindful of turning down or shutting off outdoor music when no patrons are present. Several commissioners also suggested small technical changes—speaker adjustments or removing a single speaker—could reduce impacts.
After public comment and discussion, a motion to approve the amendment with staff recommendations passed unanimously. The commission recorded aye votes from President Bridal, Vice President Wong, Commissioner Davis, Commissioner Perez, Commissioner Poggio, Commissioner Schlander and Commissioner Thomas.
Staff will continue to monitor complaints and enforce permit conditions; neighbors’ proposed hours were shared with the applicant during the hearing.
