Policy committee forwards three state-driven policy updates to full board

At the March 19 policy committee meeting, Souderton Area School District staff reviewed several policy revisions required by changes in state law and moved three substantive updates to the full board for action.

Policy 202 (eligibility of nonresident students): Committee members described existing practice that allows children who live with legal guardians in the district to enroll after filing an affidavit of guardianship. The state-school-code change under Act 67 adds requirements about validating eligibility and permits districts, in rare cases when proof is inadequate, to disenroll students. Committee members emphasized this change codifies existing practice and aligns district policy to the state law.

Policy 805.2 (school security personnel): The committee reviewed statutory updates from Act 55 of 2022 and later clarifications requiring training, background checks and reporting for school security personnel and school police. Staff noted the state now requires at least one security guard or an approved waiver from the Pennsylvania Department of Education and a 40-hour training regimen for security personnel; background checks and reporting to state entities are also required. Committee members confirmed the district already employs full-time security and police officers and that the policy updates align district language to legal requirements.

Policy 807 (opening exercises and flag displays): The committee reviewed a revision to reflect a state law change that requires schools to provide a moment of silence on the anniversary of Sept. 11. The policy also restates pledge-of-allegiance and flag-code guidance; committee members acknowledged that students who choose not to participate retain First Amendment protections.

Why it matters: Each change updates district policy to match recent state statutes and department requirements, clarifying enrollment rules, training and reporting expectations for security staff, and quiet-observance requirements for Sept. 11.

Committee action: The committee voted to forward these three policy updates to the full board for consideration; staff said four additional policies with minor changes will be posted for the board's action meeting next week and will follow the district's three-reading policy-adoption process.

Ending: Staff said the district relies on the Pennsylvania School Boards Association and local counsel for policy language and legal references. The policies will proceed through the board readings; board members may request items return to committee if desired.
