Representative Nolan West, the bill author, told the committee the measure “clarifies foreclosure surplus dealings that the sheriff has to deal with,” improves information provided to people facing foreclosure and “clarifies how to distribute any surplus that is arranged in a sale to the relevant parties.” He said unclear prior practice had exposed sheriffs to lawsuits when surplus funds were sent to the wrong parties.
The committee chair renewed the motion for passage. Seeing no discussion, members signified approval and the chair announced the minutes and the bill were adopted and moved to the General Register.
No public testimony was offered on House File 1027 during the hearing. The committee record shows the A1 amendment was previously adopted and the bill was presented “in the shape” the author requested before the motion to advance it.
