Commission backs fixes to use table, adds retail tobacco specialty classification and adjusts parking standards

Midvale Planning Department staff presented a multi-part text amendment on March 26 that corrects a flipped entry in the city use table for financial institutions (drive-up vs. non-drive-up status), adds retail tobacco specialty businesses to specific commercial zones, and revises parking standards for medical cannabis pharmacies, retail tobacco specialty businesses and retail/service commercial uses.
Staff explained that the tobacco specialty designation and licensing are administered through the Salt Lake County Health Department and that a business typically falls under the retail tobacco specialty classification when nicotine or tobacco products constitute 15% or more of floor area. If a tenant sells less than that threshold, staff said it would be treated as a general retail and service commercial use and subject to a general retail tobacco license through the county.
The amendment also fixes inconsistencies between zone-specific parking standards and the city’s land‑use definitions so that parking requirements are clear and enforceable. Staff described the proposed changes as corrections and clarifications rather than new policy.
No public comment was offered during the hearing. The Planning Commission voted unanimously to recommend the amendment to the City Council. The City Council will consider final adoption.
