The Midvale Planning Commission on March 26 approved a conditional use permit for a dental office at 7065 South State Street and voted unanimously to recommend three separate text amendments to the Midvale City Council.
The commission approved the conditional use permit for a dental office in the State Street Commercial (SSC) zone after staff reported the project met conditional-use criteria, including parking: the applicant was required to provide 20 spaces and proposed 27. The motion to approve passed by roll call with Chair Tara Anderson and Commissioners Edwards, Snow, Lidke and Tibbetts voting yes.
The commission also recommended that the City Council approve three city-initiated code changes: - A text amendment clarifying duplex overlays and the duplex dwelling definition (Midvale Municipal Code sections 17-7-315 and 17-2-4); the change removes language requiring a duplex be owned by a single owner and clarifies subdivision of duplexes. The commission voted to recommend approval to the City Council by roll call (Chair Anderson and Commissioners Edwards, Snow, Lidke and Tibbetts voting yes). - A text amendment correcting errors in use tables (financial institutions with and without drive-up windows), adding retail tobacco specialty businesses to certain commercial zones, and aligning parking standards for medical cannabis pharmacies, retail tobacco specialty businesses and other retail/service commercial uses (Midvale Municipal Code sections 17-7-7.2, 17-7-12.2, 17-7-13.2 and related sections). The commission recommended approval by unanimous roll call vote. - An amendment to section 17-4-1 of the Midvale Municipal Code to remove a fixed dollar amount for planning commission stipends and allow the City Council to set the stipend through the budget process. The commission recommended approval by unanimous roll call vote.
Each motion was presented during public hearings with no members of the public speaking on these items. The commission’s role on the three text amendments was advisory; the City Council will make final determinations.
