Conservation commission approves Marigold Lane house reconstruction, adds limit-of-work condition

The Town of Lakeville Conservation Commission approved a Notice of Intent (DEP file SE192935) on March 25 for reconstruction and additions at 1 Marigold Lane (Assessor Map 41, Lot 2-16). The project includes a second floor addition, a south-side ell with a garage under, a gravel driveway and grading along the water side to access the garage.

Applicants and their surveyor described existing framing already in place for the structure’s footprint and said a siltation barrier (silt fence and straw waddles) was installed and visible at the site. Commissioners and the agent discussed the need for a clearly defined limit of work in the field and recommended marking that limit with construction plastic (orange “snow” fencing) or similar materials so crews do not extend work closer to the inland bank or within regulated buffer zones.

Before closing the hearing the commission added a special condition: plastic snow fencing defining the limit of work must be installed and will be listed in the permit conditions. The motion to approve the NOI noted that the project will be subject to the commission’s standard pre-, during- and post-construction conditions; the commission also recorded that the agent (Mark Minton) should be notified prior to start of outside work so staff can verify erosion controls and limit-of-work markings.

Commission members noted that Natural Heritage provided a negative response for the site and that DEP filings were in process; the transcript records a DEP file number (SE192935) and a DEP tracking number discussed at the meeting. The commission voted to approve the NOI with the added condition; the record shows the motion, a second, and voice approval.

The commission closed the hearing with the conditions on the permit and administrative steps recorded for the applicant.
