The Town of Lakeville Conservation Commission on March 25 voted to issue a Negative 3 Determination for work at 4 Court Circle, finding the proposed deck addition requires the commission’s standard erosion controls and an agent inspection before outside work starts.
Commission members were told the existing house sits just outside the 100-foot wetland buffer (about 105 feet according to measurements cited at the meeting), while the proposed addition would extend “a little bit” into the 100-foot buffer. The commission’s agent said the work appeared to involve minimal excavation and footings rather than new foundation work.
The applicant’s representative said post holes for the deck would be excavated with a small excavator and that they planned to install erosion controls prior to disturbance. The representative told the commission, “I’ll put siltation across the whole back if that’s what you’d like to see.” The commission discussed acceptable measures, including silt fence, straw/hay bales, or coir logs (sometimes called “sausages” by contractors), and emphasized that any installed silt fence must be properly trenched and stapled to stakes.
The commission motioned and approved a Negative 3 Determination with a recorded condition that the agent be notified to inspect the silt fence or other erosion controls before work begins. Commissioners affirmatively voted the motion; the meeting record shows the motion, a second, and unanimous voice approval.
The commission advised the applicant to monitor erosion controls during heavy rains and to repair or replace them if they lift or wash away. The commission also confirmed that a building permit application should be pursued separately and advised the applicant to tell the building department that the conservation commission had approved the work.
The commission closed the item after recording the motion and conditions; the owner was not present at the hearing but was represented by a contractor.
