Wagoner County commissioners on March 10 considered a proposed code amendment (Resolution 2025-029) to the county’s zoning code affecting mining and quarry services. Planning staff advised against removing mines from the conditional-use process and outlined the protections conditional use provides, such as the ability to add conditions including setbacks, lighting, hours and road impacts.
Staff report: Casey Sanders, planning staff, told the board that moving mining to a use-by-right zoning category would limit the county’s ability to impose site-specific conditions and protections for surrounding property owners. Sanders recommended retaining mining as a conditional use to preserve a permit-based process the county can tailor to particular sites.
Commissioner discussion: Commissioners expressed concern about road damage and the extraction of native material without regulatory compensation for road wear. One commissioner urged planning and zoning to draft a new code category for mines that would include road-relief measures and other safeguards; that motion failed for lack of a second. An earlier motion to approve the resolution also failed for lack of a second.
Why it matters: Mining and material-extraction uses can create heavy road wear and other externalities. The board and staff said the county needs a code that balances landowner rights with protections for neighboring property owners and county infrastructure.
Action: No formal code change was adopted. Planning and zoning will be asked to study the issue further and if feasible propose a code category or amendments that address road impacts and other county concerns.
