Board debates Vision 2050 and Orange Code; school district and charter-procedure concerns drive follow-up work

The Board of County Commissioners held a lengthy work session on March 25 to review the Vision 2050 comprehensive-plan update and the draft Orange Code land‑development regulations. Commissioners and the Orange County School Board chair pressed staff on how new planning rules would affect school capacity, the county charter’s multi‑jurisdiction review requirements and the county’s legal exposure.

What was presented: County planners summarized Vision 2050’s “place‑type” approach, which replaces some existing future‑land‑use categories with transect-based place types (T0–T6) and ties zoning form standards to those place types. Planning staff said the package is intended to focus growth in a “targeted sector,” keep the long-established neighborhoods’ character, and preserve environmental and rural lands.

Code and process changes: The Orange Code draft collapses many existing use categories and standardizes form-based development criteria countywide. Officials said the change will simplify use tables (reduced from dozens of pages to a few), reduce the number of zoning districts and require more context-sensitive reviews. The draft also creates new application paths: “small area” and “large area” rezonings, master plans for very large developments, and a new “density activation” procedure proposed for targeted-sector projects that would allow developers to activate higher residential entitlements only after a capacity review.

School-capacity dispute: Chair of the Orange County School Board, Rita Jacobsa, said she supports the broad goals but objected to elements of the proposed administrative process. Jacobs urged the county to follow the local charter’s procedure that requires multi‑jurisdiction review for comprehensive-plan amendments and rezonings that expand residential density where school capacity is strained. She warned the board that an administrative alternative might circumvent the charter’s protections and allow municipalities or developers to secure density increases without adequate regional review.

County staff response: Planning and county legal staff said they had negotiated procedures with OCPS staff over the prior nine months and proposed the density‑activation process to provide OCPS an early seat at pre‑application reviews and a formal way to require mitigation, phase development, or ask the Board to review an activation where capacity is lacking. Staff also cautioned that broadening multi‑jurisdictional approvals or applying the activation process countywide could effectively convert the plan into an overlay requiring extra approvals for many projects; that approach could raise legal and implementation challenges.

Board direction and next steps: Commissioners asked staff to continue negotiations with OCPS, the county attorney and city attorneys to refine the procedures and to return with focused policy language. Commissioners also asked for more analysis of transportation and school‑impact modeling, including the long‑range transportation plan and a fiscal‑sustainability tool contractors are preparing. Chair Jacobs reiterated that she wants the county to preserve the charter’s review protections and to return with legal language and a timeline.
