Portland Historic Preservation Board denies proposed amendments to 308 Danforth Street certificate of appropriateness

PORTLAND, Maine — The Portland Historic Preservation Board voted 4–0 on June 4 to adopt a motion finding that the applicable standards under section 17.8.2 were not satisfied and thereby denying proposed amendments to the certificate of appropriateness for 308 Danforth Street.
The decision followed deliberations on an application the board had first heard and tabled at its May 21 meeting. Staff provided a draft set of findings prepared in conjunction with corporation counsel for the board to consider before taking final action. "A draft set of findings that were prepared by staff in conjunction with, corporation counsel," staff noted when presenting the materials.
Board members said the staff findings accurately summarized the prior hearing and the standards used for review. Board discussion noted that standards 1–6, and standards 9 and 10, were evaluated and that standards 7 and 8 were not relevant to the scope of the proposed work. With no substantive edits offered to the draft findings, Ms. Fagan Gold moved the motion, which she read aloud: "The board finds that all of the standards and 17.8.2 have not been satisfied and therefore denies the proposed amendments to the certificate of appropriateness." Mr. Hodgson seconded the motion.
The chair called the roll. Michael Hutchins, Robert O'Brien, Valerie Paquin Gould and Brad Miller each voted "yes." The chair announced, "The motion carries, 4 in favor." The transcript shows the application had previously been tabled on May 21; the minutes from that meeting recorded a 6–0 vote to table review of the application.
The denial applies to the amendments to the certificate of appropriateness as presented to the board; the board did not adopt any alternative approval or conditions at the June 4 meeting. Staff had made the draft findings available to the board just before the June 4 session and indicated the findings were open to editing by members prior to a motion.
The board concluded its business and confirmed its next meeting date as Wednesday, June 18.
