House approves limits on ultra-processed ingredients in school meals for larger districts

The Utah House on Feb. 27 passed third-substitute House Bill 402, which restricts the use of specified ultra-processed ingredients in school meals during the school day for districts above a size threshold; the third substitute excludes districts with under 5,500 students, charter schools and vending machines.
Sponsor Representative Chevrier said the bill is intended to improve students' nutrition and classroom focus by removing chemicals and additives (a list of targeted ingredients was distributed to members) from meals prepared in school kitchens. The third substitute retained parental ability to send treats for parties and allowed teachers to give treats with parental consent.
Floor discussion covered implementation and cost concerns. Representative Matthews asked about the fiscal impact on school lunch programs; Representative Chevrier said several districts already have transitioned menus and had not seen substantial cost increases and that menus with the alternative ingredients were available. Representative Pucci raised concerns about unintended consequences for free and reduced lunch programs that operate on small per-meal budgets and the potential for students to buy vending-machine snacks instead; vending machines and charters were carved out of the bill after committee and floor negotiation.
The House adopted the third substitute and passed HB 402 by recorded vote: 38 yes, 34 no. The bill will be sent to the Senate for its consideration.
