Sean West, public works, told the commissioners he had contacted QuickComm and received a response from the company's representative indicating QuickComm had sent an MOU from its legal staff and that QuickComm believed the MOU addressed the county's concerns.
West read portions of the MOU summary to the board, explaining that QuickComm proposed that installations in the county right-of-way be installed "at its own risk" and that QuickComm would provide as-built drawings after completion. "QuickComm acknowledges that such installation is at its own risk," West said, summarizing the company's language, and added that QuickComm had indicated it would indemnify the county except when damage resulted from county negligence.
Commissioners asked whether the county had received the required as-built plans from QuickComm. West said he believed GIS had received them but would confirm, noting staff had previously worked with QuickComm to agree on as-built format. The board directed county legal counsel to review the MOU and asked staff to check with GIS for delivery and proper format of any as-built drawings.
No formal contract was approved at the meeting. The board instructed staff to bring the MOU and any received as-built documentation to the next appropriate meeting or to an executive session for legal review if needed.
