The Adams County Planning and Zoning Committee postponed consideration of a rezone request from Patricia and Stuart Duckworth and Joanne Duckworth and sent the matter back to the township for additional information.
Planning staff described a request to rezone a parcel from A-135 exclusive agricultural district to A-115 exclusive agricultural district for property in the Southwest Quarter, Northeast Quarter of Section 9 T19N R7E (parcel 6-1-60-7). The application packet included a letter from the Dempsey law firm explaining aspects of the court order partitioning the property; staff said a court order does not override local zoning and recommended waiting for township input.
A motion to postpone and return the item to the township was made and seconded; the committee conducted a roll-call vote and approved the referral. Committee members indicated they wanted information or a formal position from the township before acting on the rezoning request.
The item will return to the committee after the township provides the requested information or a decision.
