The Brandon Planning Commission approved a text change to setback exceptions for patios and a wording clarification replacing "paved patios" with "hard surface patios."
The amendment clarifies that an open, unenclosed and uncovered patio serving an interior unit in a row of townhouses may extend to the side property line so that residents can have usable outdoor space that connects units rather than a narrow strip. The change is intended to address how the existing five-foot-from-side-yard rule applied awkwardly to attached units.
Commissioners also resolved a drafting ambiguity: the packet used the phrase "paver patios," which several members read as "pave paper." A commissioner proposed and the commission approved changing the term to "hard surface patio" in both paragraphs where it appeared. "That way? I get what you're saying," one commissioner said when the suggested edit was discussed.
A member moved to approve the change provided the word "paved" is changed to "hard surface" in both paragraphs; another member seconded, and the motion carried.
The amendment will move on to the City Council for its process in the normal ordinance schedule.
