Committee advances Living Donor Protection Amendment Act to draft report

The Committee on Business and Economic Development advanced the Living Donor Protection Amendment Act of 2025 to a draft committee report after a unanimous voice vote on March 20, 2025. Chair Kenyon McDuffie moved to draft the report with leave for staff to make technical, editorial and conforming changes; the motion carried and the committee signed off.

The measure, listed in committee as Bill 26-22, "would prohibit insurers from taking certain actions based solely on an individual's status as a living donor," McDuffie said during the committee meeting. The committee print expands the living-donor definition to include tissue donation in addition to organ donation and authorizes the Commissioner to expand the bill's tissue and organ definitions by rule.

Under the committee print, the bill's protections would apply to life insurance, disability insurance and long-term care insurance policies delivered or issued for delivery after Jan. 1, 2026. The bill was originally introduced in a prior Council period and was reintroduced in Council Period 26; the committee record notes prior referral and a public hearing held in December 2024.

No members of the public spoke during the committee's consideration of the bill at this meeting, and committee discussion was limited to the chair's procedural summary and the committee's motion to advance the item. The motion authorized staff to prepare a draft committee report and to make technical and conforming edits before the report is finalized.

Next steps: staff will prepare the committee report in print and may make technical, editorial and conforming changes before the committee formally transmits the report. The committee did not set a date for a subsequent markup or Council floor action during this meeting.
