Council approves accessory building at 585 East Platte Lane; main building permit tabled over water-rights question

The City Council on March 25 approved an accessory building permit for Carwin and Brooke Carter at 585 East Platte Lane but voted to table consideration of a separate building permit for the same parcel while staff verifies culinary-water entitlement and related historic paperwork.
Planning and zoning staff told the council they reviewed the accessory building application and found it met the town's specifications. "They met our specifications and everything," Planning and Zoning staff member Dennis said during the meeting. Council members then moved and seconded a motion to approve the accessory-building permit; the motion passed.
At the same meeting staff reported a longer review of the primary building permit for the property uncovered historical complications tied to the town's current water ordinance. Staff said the city previously required 1.5 acre-feet of culinary water (or payment of roughly $4,596) for permitting; records from February 2002 indicate a payment was recorded for the parcel, and minutes dating to March 29, 2000 were also in the file.
"We probably recommend that you table it for a work session on this to talk about this," Dennis said, urging the council to consider whether the parcel should be grandfathered under earlier rules or required to meet the current ordinance's water share requirement. City staff said they will research and produce documentation and receipts and asked the council to schedule a work session before the next regular meeting.
The council moved and seconded a motion to table the main building permit at 585 East Platte Lane to allow staff and council time to review the historical documentation and determine whether to require the current water entitlement or to grandfather the property. The motion to table carried.
Staff noted secondary water is documented for the lot (a half share), but no clear proof of the culinary-water share required under current rules was found. City staff said they will attempt to locate receipts and related minutes to clarify whether the earlier payment satisfies today's ordinance or whether the applicant must secure a half-acre-foot of culinary water or pay an in-lieu fee.
The council did not take a final vote on the main building permit; the item will return after the work session and follow-up research.
