Tim Justice, senior investigator for Bay County Code Enforcement, presented photographs and testimony showing overgrowth, appliances and other junk around what appears to be a single-wide mobile home. Justice said a prior magistrate had given the respondent five days to comply and, after noncompliance, fines and abatement authority followed. Code enforcement recommended the magistrate find the respondent failed to comply, impose the fines and authorize county staff and any hired contractors to abate and record costs as liens.
The magistrate accepted that recommendation, imposed the initial $300 fine and the $50 daily fine for noncompliance, and authorized staff to abate the nuisance and record abatement costs as liens against the property and other real or personal property owned by the respondents. The magistrate’s order directs that the Board of County Commissioners may assess abatement costs against the property pursuant to the Uniform Assessment Collection Act and chapter 21 of the Bay County Code.
No owner or representative appeared at the hearing to contest or address the photos and testimony; the magistrate concluded the matter and directed enforcement to proceed according to the order.
