The Fort Pierce special magistrate on March 17 found that a vacant building at 101 Seaway Drive presents a nuisance and ordered the property owner to resecure all openings within seven days.
City code enforcement entered multiple photographs and said the structure โ formerly a barbecue business โ had been boarded previously, but the boards had been removed and openings left unsecured. The city cited the property under the vacant-building board-up requirement (cited in the hearing as 103-341) and IPMC 301.3 for vacant structures and land.
The magistrate ordered the violator to reseal all openings, including doors and windows, with painted exterior-grade plywood or similar commercially available products installed in a workmanlike manner within seven days. The magistrate warned that failure to comply would result in a $100-per-day fine for each day the condition continues and authorized the city to abate the nuisance and assess costs to the property. A 30-day right to appeal was also announced.
City staff said they had prior contact with the business/property for earlier violations and had asked for boards and signs to be removed previously; however, for this case staff reported no contact with the owner regarding the current condition. No estimate of abatement cost was provided at the hearing.
