Appeal over conditional use denial withdrawn; Marion County staff recommends no action

The Marion County Board of Commissioners on March 19 heard an informational item on an appeal of a hearings officer’s decision denying a conditional-use request for a manufacturing use on commercial land in the unincorporated Quineby area, north of Kaiser. Planning staff told the board the applicant formally withdrew the application and recommended the board take no action because there is no active case.
Planning staff said neighbors had appealed the original staff approval to the hearings officer, arguing the business operations caused noise and on-site outdoor manufacturing and welding activities that were not compatible with the area. The hearings officer denied the application, and the applicant then appealed that denial to the board. Austin, a planning staff member, told commissioners that the applicant later sent written notice withdrawing the application and had also sent texts to a commissioner requesting leniency while seeking relocation for a tenant.
Because the withdrawal was filed and entered into the public record, staff advised the board there was no application before them to accept or deny. Commissioners confirmed the written withdrawal had been provided to staff and entered into the record. No motion or vote was necessary on the appeal item.
