The Petersburg City Council on March 18 voted to direct the city manager and city attorney to review and develop a memorandum of understanding (MOU) with "Team Loaded" and to present any necessary formal actions, including supplemental appropriations, during the council's regular April meeting cycle.
The action followed a closed session called under multiple provisions of the Virginia Code. Council members discussed the acquisition and disposition of publicly held real property; personnel matters involving the assignment, performance and appointment of a specific public office; legal advice and updates from the city attorney on probable or actual litigation; and the potential award of a public contract. The council also voted to add discussion of sections 22.1-92 and 22.1-93 of the Code of Virginia to the closed session agenda.
Vice Mayor Hill moved the motion directing staff to develop the MOU; Council member Smith Lee seconded. The motion passed in a roll-call vote with Council members Cuthbert, Jones, Myers, Westbrook, Smith Lee, Vice Mayor Hill and Mayor Perrin recorded as voting "Aye." The council earlier certified the legality and scope of the closed session by roll call; that certification passed with one abstention by Council member Myers.
The closed session was convened pursuant to provisions the council recited on the record, including references to sections of the Code of Virginia and the Petersburg city code. On the record, the council identified 2.2-37 11 (as recited), 58.1-32 21.6 (as recited), and section 106-1 of the Petersburg city code, and specifically invoked discussion under authority cited as sections 22.1-92 and 22.1-93 of the Code of Virginia.
The council gave staff direction but did not adopt final contract terms in open session. The motion directs the city manager and city attorney to develop the MOU with terms substantially similar to the draft presented in the meeting and to bring any necessary formal actions, including supplemental appropriations, for council consideration during the regular April cycle.
The council adjourned the closed session after certifying that the matters discussed were appropriate for closed session under the cited authorities. Following the certification vote, the council approved the staff-direction motion on the MOU and adjourned the closed-session meeting.
