The Garland City Council unanimously adopted an ordinance on March 18 levying assessments for construction of a 10-foot alley behind the addresses 401, 405 and 409 School Street (District 8).
City staff explained the alley petition was initiated by property owner Yesenia Morales (409 School Street) and that the city prepared an opinion of probable cost based on the term concrete contract for a 10-foot alley contiguous between College Avenue and Walnut Street. The city’s policy limits property owner share to one-third of calculated cost; staff calculated a per-linear-foot assessment of $127.80 under the cost estimate used for the roll.
Because the law prohibits levying assessments that exceed the enhancement to property value, the city hired an independent appraiser (Mark Sadler, BBG Real Estate Services). The enhancement study capped the assessments for two properties below the initial calculated assessment: the original calculated assessments were crossed out on the roll. Staff reported the final assessment roll totals $23,487.71 among the three properties.
Staff indicated property owners returned the petition promptly and that the owner who initiated the petition (Ms. Morales) supported proceeding with the alley paving. Councilmember Ott moved to approve the ordinance; Deputy Mayor Pro Tem seconded and the council voted unanimously to adopt the assessment ordinance.
