Committee clears bill to update data-challenge appeals under Government Data Practices Act

The Judiciary Finance and Civil Law Committee adopted an A1 amendment and re-referred House File 1836 to the State Government Finance and Policy Committee. The bill would modify the process under the Government Data Practices Act (chapter 13) for challenging the accuracy or completeness of government-held data and for handling nonpublic information during appeals.
Representative Cleburne told the committee the bill would allow nonpublic data to be shared between agencies to facilitate appeals to the commissioner of administration and would keep inaccurate or incomplete data private at the Department of Administration during appeals. The sponsor said the goal is to prevent improper dissemination of private data while permitting agencies to submit private material needed to resolve appeals.
The bill’s changes, the author said, are aimed at ensuring that requests to correct inaccurate government-held information can be resolved without turning private data public solely because it was submitted as part of an appeal. The Department of Administration was available to answer member questions but offered no extended testimony.
After no public opposition at the hearing, the committee re-referred the bill to the State Government Finance and Policy Committee for further consideration.
