The Montezuma County Board of County Commissioners on March 18 approved a two‑lot moderate subdivision and a commercial rezoning for property at 26620 Road J in Cortez, submitted by Jay and Karina Cruzan.
The Cruzan parcel, described in the public hearing notice as approximately 10 acres, will be split into roughly 3.5 acres (north) and 6.5 acres (south). Don (planning staff) told the board, “The Cruzans, this is the property that’s just south of the high school, and beside their other PUD. They are proposing to split that into roughly 3 and a half and 6 and a half acres. And they would like to, request commercial rezoning on the North parcel, which has their construction business. And they, also with above the shop, a couple of apartments.”
The applicant told commissioners he was available to answer questions but offered no additional material. Planning and zoning recommended unanimous approval with the condition that the applicants notify future buyers of the land use code and that a 30‑foot access easement be maintained on the west side to serve the south parcel. Don confirmed the north parcel is connected to the subdivision’s sanitation system through an easement and that the applicants reported only light construction equipment on site (a skid steer and small trailers), a fact cited by staff in recommending commercial rather than heavy industrial zoning.
Commissioners moved and seconded the measure; after no public comment, the board voted to approve the subdivision and the AR‑3/9 and commercial rezoning with the planning commission’s stipulations. The chair announced, “With that, you are approved, sir.”
The approval carries the condition discussed at the hearing: maintenance of a 30‑foot access easement on the west side and notification to future owners about applicable land use code requirements.
