The Rathdrum City Council on Tuesday voted to grant a request from developer Hayden Homes to reconsider the council's prior denial of a zoning map amendment for an aerostat/subdivision project.
City staff told the council the applicant filed the request within the statutory 14-day window after the notice of decision. "They have made their request within the statutory, 14 days, required from the notice of decision," a city staff member said during the meeting.
The move will restart council deliberations on the earlier denial at a future meeting, staff said, but it is not a public hearing. The council's action on Tuesday permitted the applicant to return and explain how it has addressed the conditions that led to denial; the hearing portion for public comment remains closed because this is a continued quasi-judicial process. The city attorney explained that if new information is introduced at the reconsideration it could reopen the public hearing.
