Bay County Planning Commission members on April 15 recommended changing about 1.5 acres at 9727 Highway 79 from a conservation habitation future‑land‑use designation to “village center” and supported a conditional use permit to allow a boat sales and service facility at the same address.
Ian Kralin, planning staff, told the commission the application would change “approximately 1.5 acres from conservation to village center” and that the proposal “meets all of our regulations.” He recommended the commission find the amendment and zone change consistent with the county Comprehensive Plan and forward a recommendation to the Board of County Commissioners to approve the proposed land‑use and zone change.
The applicant, Derek McCarty of Northstar Engineering, said the boat sales and service business would locate in the village‑center area and that the design is being coordinated with the Florida Department of Transportation for access and stormwater. “We have already had meetings with the Department of Transportation on how they want their stormwater handled,” McCarty said, and added DOT will allow access only from Sunday Circle, requiring coordination and improvements between the county and DOT to make the entrance feasible.
Planning staff presented this conditional use as dependent on the county commission’s approval of the small‑scale amendment and rezoning; the Planning Commission approved the conditional use permit on that contingency. Commissioners moved to adopt staff recommendations and recorded affirmative roll‑call votes for both the land‑use/zone recommendation and the conditional‑use permit.
The land‑use change would alter the future‑land‑use map designation from CSBH (conservation habitation) to village center and change the zoning from conservation habitation to village center zoning. Staff noted the surrounding properties already carry or are moving toward village‑center designations and identified LDR Table 16.2 and the Comprehensive Plan’s transportation element in the staff analysis.
Next steps: the Planning Commission’s recommendation on the small‑scale amendment and rezoning will go to the Board of County Commissioners for final action. The conditional use permit approved by the Planning Commission will not become effective unless and until the Board approves the land‑use and zoning changes.
Commission discussion was limited; no members of the public spoke on these items at the Planning Commission hearing.
