Commission defers initial zoning for Midland County tract in ETJ after questions about annexation and utilities

The Midland Planning and Zoning Commission voted to defer action on Midland County's request for initial zoning of a 15.6-acre tract near Farm-to-Market Road 715 in the city's extraterritorial jurisdiction.

Senior planner Daniel Humbert presented the request, saying the 15.6-acre tract comprises FM 715 right-of-way and an adjacent parcel (3314 FM 715) and currently has no city zoning because it is in the ETJ. Humbert said the parcel is being considered for Regional Retail (RR) zoning so the sheriff's office could access city water and sewer; staff recommended approval and noted the annexation must be approved by city council before finalizing zoning.

Commissioners raised procedural and substantive questions. One commissioner characterized the request as —spot zoning' because the site is remote from other retail uses; commissioners asked whether the annexation should precede a zoning recommendation and whether other surrounding parcels would also require annexation to access utilities. Humbert explained state notice to TxDOT requires a 60-day review period that does not expire until March 26 and that the rezone recommendation is being brought now to avoid later delay should council approve annexation.

Commissioner Ciesniga moved to defer the item; Commissioner Berry seconded. The motion to defer passed (recorded in the transcript as "6 4, 1 against", recorded by staff). The deferral was to allow additional information and to coordinate timing with the pending annexation and TxDOT review.
