Commission debates whether personnel and departmental control should rest with city manager or council
Summary
Commissioners flagged a tension in draft language over which body controls department creation, personnel policies and department heads, and asked staff to benchmark comparable charters and return examples at the next meeting.
During review of Articles 7 (administration) and related sections, commissioners raised a recurring question: should authority over department structure and personnel policies rest primarily with the city manager, or should council retain direct approval power for personnel policies and creation/termination of departments?
Several commissioners said typical council–manager practice places organizational and personnel authority with the city manager and professional human resources staff; others noted the current draft gives council oversight in several places. One commissioner suggested allowing the city manager to control personnel policies and department organization while preserving council oversight through budget and ordinance authority. Commissioners asked staff to benchmark language from other Texas city charters and to propose revised wording that clarifies the boundary between council oversight and manager authority.
No final statutory change was adopted at the March 10 meeting; the commission agreed to continue Article 7 discussion at the next meeting and requested sample charter language from other municipalities for consideration.
