The Leavenworth County Planning Commission voted unanimously to recommend approval of the preliminary and final plats for Elston Estates Number 2 (case DEV-24-157/158) and an exception for an irregularly shaped Lot 1 created by a proposed pond.
Planning staff said the five‑lot subdivision sits just outside Tonganoxie and is zoned RR-5 following a recent rezoning; utilities do not currently serve the site. Because the proposed pond creates an irregular lot shape for Lot 1, the applicant requested an exception to the standard lot‑shape provisions. Staff reported all lots meet the zoning district’s frontage and area requirements when measured under the proposed approach and that the plat has been reviewed by other entities and found otherwise in compliance with zoning and subdivision regulations.
The commission granted the exception and voted 8-0 to recommend final approval to the Board of County Commissioners. The county commissioners were told they will consider the item no earlier than March 26, 2025.
