Commission approves one-year extension of Unique Auto Body outdoor-storage permit amid litigation delay

The Midvale Planning Commission on March 12 approved a one-year extension of an administrative conditional-use permit (ACUP) allowing outdoor storage at 6941 South Rivergate Drive after staff and the applicant said litigation between the property owner and a homeowners association delayed establishment of the use.

Planning staff presented the extension request as limited to the existing ACUP, not a re-adjudication of the underlying permit. Staff said the Midvale ordinance requires an approved use to be established within one year of approval; the applicant reported contractor delays tied to pending litigation, including a contractor hired and a 50% down payment on contract work.

The commission voted by roll call to extend the ACUP for one year, setting the new expiration at April 11, 2026. The motion’s findings stated the extension “does not result in an unmitigated impact,” and that the applicant’s process toward commencement stalled due to litigation.

Staff emphasized the extension request was procedural: the ACUP and site conditions previously were approved and the extension preserves the applicant’s vesting that occurred at the time of the original application. The applicant did not add substantive comments during the meeting.

Motion and vote: the commission approved the extension. A roll call read by staff recorded affirmative votes from Candace Erickson, Robin Anderson, Commissioner Snow, Commissioner Lidke and Commissioner Tibbets; the motion passed and staff advised the applicant to continue working with staff as issues arise.

Practical details: staff noted there were no material changes to the previously approved site plan or ACUP conditions. The applicant indicated a contractor had been hired and had paid a 50% deposit but could not proceed while litigation is pending. The commission did not propose additional conditions beyond those in the staff motion.
