Committee advances bill renaming county guardians as county conservators in probate code

Senate Bill 98, presented to the Judiciary Juvenile Committee as a technical correction to the probate code, received a do-pass recommendation from committee members.

Sponsor Bill Kalsert said the bill is intended to correct a drafting inconsistency that left the code using the term "county guardian" where the role is better described as a financial conservator. "There's a pecking order so to speak of who can be appointed, by probate courts to serve that role," Kalsert said, explaining that the measure replaces references to county guardian with county conservator in multiple code sections so the nomenclature correctly distinguishes personal guardianship from conservatorship over finances.

Kalsert told the committee the change is designed to ease administrative burden: when counties or the state must manage long-term finances for incapacitated adults, designating a county conservator clarifies responsibilities and avoids the state stepping in as the default fiduciary where county-level capacity is more appropriate. "It's just going through different places in the code and substituting county conservator where appropriate," Kalsert said.

A motion to give the bill a do-pass recommendation was seconded, and the committee approved the recommendation by voice vote. Representative Scoggins informed the committee he has agreed to carry the bill in the House if needed.
