The Camino Real Regional Mobility Authority on March 10 approved a resolution authorizing negotiation and execution of a termination agreement with the Texas Department of Transportation that ends prior RMA–TxDOT agreements related to the Border Highway West project and settles outstanding obligations.
The action follows an updated traffic and revenue study that identified shortfalls in the project’s anticipated toll revenue, prompting RMA and TxDOT to proceed with the roadway as a non‑toll facility. “Ultimately though, this termination agreement terminates all of the agreements between TxDOT and the RMA as it relates to the Border Highway West project,” Raymond Tayas, the RMA’s executive director, told the board.
The board heard a brief history from Tayas: TxDOT managed construction while the RMA handled design and installation of toll‑collection facilities. An earlier regional toll plan executed around 2008–2009 included about $1,100,000 from TxDOT to develop that plan, with repayment provisions tied to revenues from tolled facilities. Tayas said a second agreement is being negotiated to address additional debt that passed through those earlier arrangements and to “tie up all of those loose ends.”
Board members asked about project naming; a board member noted references to both “Border Highway West” (the legal name used in the underlying agreements) and the more recent public name “Border West Expressway.” Tayas said the termination uses the legal project name in the existing contracts. A motion to approve the termination agreement was made and the board voted to carry the motion.
The termination agreement before the board is described in the meeting materials as short in operative terms with longer recitals providing the legal and historical background. Tayas said the document extinguishes debts and resolves outstanding obligations tied to the RMA–TxDOT relationship for the project, and that staff recommends approval. He also noted company personnel (Brian O’Reilly) were available if board members had technical questions.
No further conditions or follow‑up actions were listed in the board’s motion; Tayas said a separate negotiation with TxDOT to address remaining debt is ongoing.
